Migranti e "comparazione umanitaria" dei giudici in Italia


Abstract


The article discusses the specific problems of the rights of migrants in Europe and in Italy. In particular, it considers the specificity of European multiculturalism: multiculturalism “imported” by migration. Second, it emphasizes the contradictory nature of the qualification of migrants’ rights. Finally, it analyzes the Italian case law that recognizes the rights of migrants in accordance with international obligations for the protection of dignity of life of all people. This approach opens the door to an unprecedented “humanitarian” comparison about human rights.
