L'ultima stagione del diritto europeo dello sport nella giurisprudenza della Corte di giustizia: la faticosa emersione della specificità
Abstract
The essay reconstructs the most recent season of European sports law in the Court of Justice's case law, showing how the center of gravity has shifted toward a "plain" application of EU law, chiefly as it relates to competition rules and the protection of economic freedoms. Picking up the threads of the Court's jurisprudential evolution from Walrave to Meca-Medina, it then turns to the most recent decisions (TopFit, European Superleague, ISU, Antwerp, Diarra, Seraing), from which a minimalist reading of Article 165 TFEU emerges, alongside the practical sidelining of sport "specificity" with a consequent erosion of the autonomous space available to sports organizations.
