This contribution is aimed at determining the extent of the peculiar Livian clarification, in the context of the typification of the constitutive causae that should have determined the creation of the magistracy, with respect to the change in the procedure for appointing the dictator that took place after 217 BC. Unlike the literature that explained the intervention of the centuriate committee in the designation procedure on the structural level based on the previous rogatio of the praetor or in the political agreement reached between the different orders, indeed in a sense homogeneous to its own functional description in the evaluation of the historian it appeared justified by the condition for which it would have voted the conferral of a circumstantial power to strengthen the city limits and set up garrisons as well as to prepare for the removal of the bridges over the rivers. Therefore, absolute power would have been possible to exercise it in a unique way outside the boundaries of the city and the territory where in reverse the residences of the senators stood who granted the assignment voted by the centuriate committee and which constituted the specific causa enucleated by Livius as a foundation the creation of the magistracy. The temporal and institutional concatenation of the Livian discourse, the appointment of the dictator in 217 BC., the one attested in 216 BC., based on the homogeneous reference to the iussum senatorial but asserting an adhesion of later historians and omitting the recall to the interregni causa present instead in the testimonies annalistics, as well as that which occurred in 210 BC, in which the controversy between the consul and the senate concerned precisely the territorial context, had as a certain and no longer doubtful outcome the rogatio proposed by the tribunes of the plebs and the approval by means of the vote of the plebeian council.

Cette contribution vise à déterminer l'étendue de la clarification singulière de Live, dans le cadre de la typification des causae constitutives qui auraient dû déterminer la création de la magistrature, en ce qui concerne le changement de procédure de nomination du dictateur intervenu après 217 av. J.-C. Contrairement à la littérature qui expliquait l'intervention du comité centurial dans la procédure de désignation au niveau structurel sur la base de la rogatio précédente du préteur ou dans l'accord politique conclu entre les différents ordres, en effet dans un sens homogène à sa propre description fonctionnelle dans la évaluation de l'historien elle apparaît justifiée par la condition pour laquelle elle aurait voté l'octroi d'un pouvoir détaillé pour renforcer les limites de la ville et installer des garnisons ainsi que pour préparer la suppression des ponts sur les fleuves. Par conséquent, le pouvoir absolu aurait été possible de l'exercer d'une manière unique en dehors des limites de la ville et du territoire où au contraire se trouvaient les résidences des sénateurs qui ont accordé l'engagement voté par le comité centurial et qui ont constitué la causa spécifique énucléé par Live comme fondement de la création de la magistrature. L'enchaînement temporel et institutionnel du discours livien, la nomination du dictateur en 217 av. J.-C., celle attestée en 216 av. J.-C., fondé sur la référence homogène à le iussum senatorial mais affirmant une adhésion des historiens postérieurs et en omettant le rappel à l'interregni causa présent au contraire dans les témoignages annalistiques, ainsi que celui qui se produisit enfin en 210 av. J.-C., dans lequel la controverse entre le consul et le sénat portait précisément sur le champ d'application territorial, eut pour résultat certain et non plus douteux en effet la rogatio proposée par les tribuns de la plèbe et l'approbation par le vote du conseil plébéien.
